Terms & Conditions – CHATTERBOX ENTERTAINMENT

1. Definitions
In these Terms & Conditions (“the Agreement”):

  • “Performer” refers to CHATTERBOX ENTERTAINMENT, a UK sole trader providing entertainment services.
  • “Client” refers to the individual, company, or organisation engaging the Performer’s services.
  • “Event” refers to the occasion, function, or engagement for which the Performer has been contracted.

2. Scope of Services
The Performer shall provide entertainment services, which may include but are not limited to, live character acting, themed hosting, interactive audience engagement, and related performance activities, in accordance with the specifications agreed in writing between the Performer and the Client prior to the Event.

3. Booking Procedure and Confirmation
3.1 A booking shall be deemed provisional until the Performer has received a signed confirmation from the Client and a non-refundable deposit equivalent to 50% of the total fee.
3.2 The Performer reserves the right to decline any booking request at their sole discretion.
3.3 The balance of the agreed fee shall be payable no later than 48 hours prior to the Event date unless otherwise stipulated in writing.

4. Cancellations and Postponements
4.1 In the event that the Client cancels the booking more than 5 days prior to the Event, the deposit shall be retained by the Performer as liquidated damages.
4.2 Cancellations made within 72 hours of the Event shall render the Client liable for the full contract price.
4.3 Should the Performer be unable to fulfil the engagement due to illness, injury, or other circumstances beyond their reasonable control, the Performer shall refund all monies paid by the Client, or, where possible, offer an alternative date or substitute performer of comparable skill and presentation, subject to the Client’s agreement.

5. Performance Conditions and Client Obligations
5.1 The Client shall ensure that the performance area is safe, secure, and fit for purpose, with adequate lighting, ventilation, and access to any facilities reasonably required by the Performer, including but not limited to a private changing area. 

5.2 Please note that CHATTERBOX ENTERTAINMENT DOES NOT offer services in private or clients homes or clients personal environments. This is for the performers safety and for Public Liability Insurance purposes. Any performance spaces should be considered public for example corporate buildings, village halls etc.
5.3 The Client shall be responsible for ensuring that the audience and attendees conduct themselves in a manner that does not endanger the Performer or impede the performance.
5.4 The Performer reserves the right to suspend or terminate the performance without liability in the event of unsafe conditions, harassment, or inappropriate behaviour directed towards the Performer or associated personnel.

6. Force Majeure
The Performer shall not be held liable for any failure or delay in performance arising from circumstances beyond their reasonable control, including but not limited to acts of God, extreme weather, venue closure, transportation disruption, or governmental restrictions.

7. Insurance and Liability
7.1 The Performer maintains public liability insurance through Equity.
7.2 Except in cases of death or personal injury caused by the Performer’s negligence, the Performer’s liability for any loss, damage, or expense arising from the performance shall be limited to the total amount paid by the Client under this Agreement.

8. Intellectual Property and Media Usage
8.1 Unless expressly prohibited in writing by the Client prior to the Event, the Performer reserves the right to capture, use, and publish photographs, video recordings, or other media from the Event for promotional purposes.
8.2 The Client shall not reproduce, distribute, or commercially exploit any performance material, scripts, or character likenesses without the Performer’s prior written consent.

9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, and the parties submit to the exclusive jurisdiction of the courts of the United Kingdom.

10. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior negotiations, representations, or agreements, whether written or oral, relating to the subject matter herein.
